Terms & Conditions – Voxalya Communication

1. Definitions

Website: the website available at www.voxalya.ca
User: any person browsing the Website or using the offered services
Services: all digital communication services offered by Voxalya Communication (graphic design, video production, websites, social media posts, stationery, writing/copywriting, SEO, etc.)
Packages: monthly subscription services, billed at the beginning of each month for the duration of the commitment
À la carte services: one-time services billed 50% at order and 50% upon delivery

2. Purpose

These Terms & Conditions define how to access and use the Website and the conditions under which Voxalya Communication provides its Services.

3. Access to the Website

Access to the Website is free of charge and does not require creating an account.

Voxalya Communication reserves the right to modify, suspend, or temporarily discontinue all or part of the Website without notice or compensation.

4. Description of Services

Voxalya Communication offers:

Monthly packages: payment at the beginning of each month for the ongoing provision of agreed services.
À la carte services: services billed 50% at order and 50% upon delivery.

Delivery timelines are defined and validated case by case, depending on the nature and scope of the service.

5. Financial terms

Payment method: Interac e-Transfer (email and payment instructions provided by Voxalya Communication).
Package billing: an invoice is issued on the 1st day of each month and is payable upon receipt.
À la carte billing: first invoice of 50% at order, second invoice of 50% upon delivery.
Late payment: any delay of more than 7 days from the date payment instructions are received will automatically, and without formal notice, result in late interest of 1.5% per month (18% per year) on the total amount due.

6. Intellectual property

All Website content (texts, images, logos, mockups) is the exclusive property of Voxalya Communication or its partners. Any reproduction, representation, or distribution in whole or in part is prohibited without prior written authorization.

Intellectual property rights to deliverables (logos, websites, visuals) are transferred to the Client only upon full payment of the final invoice.

7. User obligations and restrictions

The User agrees not to use the Website or the Services for illegal purposes or in a manner contrary to public order or morality.

Prohibited activities include, without limitation: hacking, distributing unlawful content (defamatory, hateful, pornographic), spamming, and infringement/counterfeiting.

In the event of a breach, Voxalya Communication may suspend access to the Website and remove any disputed content, without prejudice to claims for damages.

8. Limitation of liability

Services are provided in accordance with professional standards and based on information communicated by the Client.

Voxalya Communication is not responsible for delays or incidents beyond its control (force majeure, hosting outage, Internet disruption).

Indirect damages are excluded (data loss, loss of profits, business losses).

Voxalya Communication’s liability, regardless of the legal basis, is limited to the total amount paid by the Client for the service concerned.

9. Term and termination

Packages run for the agreed duration and may be renewed each month for the duration of the commitment.

Either party may terminate a Package with 15 days’ written notice.

À la carte services end upon final delivery, subject to full payment.

10. Changes to these Terms

Voxalya Communication may modify these Terms at any time. The new terms will be posted on this page and will take effect upon publication. Users are encouraged to review them regularly.

11. Governing law and jurisdiction

These Terms are governed by Québec law. Any dispute relating to their interpretation or execution will be submitted to the courts of the judicial district of Gatineau, Province of Québec.
